These Terms of Service ("Terms") apply to your use of powertow.com and to any purchase you make from Northwest Mfg., Inc., doing business as PowerTow ("PowerTow," "we," "us," or "our"). By using our website or placing an order, you agree to these Terms. If you do not agree, please do not use the site or place an order.

1. Our products

PowerTow builds aircraft tugs, hook up kits, spares kits, and related ground support equipment in Hayden, Idaho. We work to describe and photograph our products accurately. Colors, specifications, and features may vary slightly, and we may update products and designs without notice.

2. Fit and proper use of our equipment

An aircraft tug moves a valuable aircraft, so fit and safe operation matter. When you ask us which tug fits your aircraft, our recommendation is based on the information you give us, such as aircraft type, weight, and tire size. You are responsible for confirming that the equipment is compatible with your specific aircraft and how you use it, and for giving us accurate information.

You agree to read and follow the operating instructions and safety guidance that come with the equipment, to use it only for its intended purpose, and to keep it in good working condition. PowerTow is not responsible for damage or injury that results from misuse, from ignoring instructions, from modifications we did not approve, or from using the equipment with an aircraft it was not selected for.

3. Pricing, payment, and taxes

Prices are in US dollars and may change without notice. A price error may be corrected, and if it affects an order you have already placed, we will contact you before shipping. Payment is due at the time of order unless we agree otherwise in writing. You are responsible for applicable sales tax, shipping, freight, and for any customs duties, import taxes, and brokerage fees on international orders. We accept payment through the methods shown at checkout. Financing, where offered, is provided by third party lenders under their own terms, and we are not the lender.

4. Order acceptance

Your order is an offer to buy. We accept it when we confirm it or ship it. We may decline or cancel an order for reasons such as product availability, pricing errors, suspected fraud, or an inability to ship to your location. If we cancel a paid order, we will refund you in full.

5. Shipping and delivery

Lead times and delivery dates are estimates, not guarantees. Large equipment usually ships by freight carrier. Title and risk of loss pass to you when we hand the order to the carrier. Inspect your shipment on delivery, and note any visible damage on the carrier's paperwork before you sign. Contact us right away if something arrives damaged. 6. Returns and warranty

Our Return Policy and Warranty Policy are part of these Terms: Return Policy and Warranty. If these Terms and those policies conflict, the specific policy controls.

7. Disclaimer of warranties

EXCEPT FOR THE EXPRESS WRITTEN WARRANTY IN OUR WARRANTY POLICY, OUR WEBSITE AND PRODUCTS ARE PROVIDED "AS IS," AND TO THE FULLEST EXTENT ALLOWED BY LAW WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Some states do not allow certain disclaimers, so some of this may not apply to you, and you may have other rights that vary by state.

8. Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW, POWERTOW WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOSS OF USE, OR DOWNTIME, ARISING FROM YOUR USE OF THE WEBSITE OR PRODUCTS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO A PRODUCT WILL NOT EXCEED THE AMOUNT YOU PAID FOR THAT PRODUCT. Nothing in these Terms limits liability that cannot be limited by law.

9. Email and text messages

Email. By giving us your email address, you agree that we may email you about your order and, unless you opt out, about our products and news. Use the unsubscribe link in any email to stop marketing emails.

PowerTow text messages. If you check the box to receive texts, you agree to receive recurring marketing and informational text messages from PowerTow at the mobile number you gave us, sent using automated technology. Consent is not a condition of any purchase. Message frequency varies. Message and data rates may apply. Reply STOP at any time to opt out, or HELP for help, or contact us at [phone number] or [email address]. Carriers are not liable for delayed or undelivered messages. We will not share your mobile number or text consent with third parties or affiliates for their own marketing. See our Privacy Policy for how we handle your information.

10. Intellectual property

The PowerTow name, logos, slogan, product names (including SuperTow, ThunderVolt, and 40EZ), photos, text, and website design belong to Northwest Mfg., Inc. or its licensors and are protected by law. You may not copy, reproduce, or use them for commercial purposes without our written permission.

11. Acceptable use of the website

You agree not to misuse our website, attempt to break into it, interfere with it, use automated tools to scrape it, or submit false, misleading, or unlawful information.

12. Export and legal compliance

You are responsible for following the laws that apply to your purchase and use of our products, including export and import rules for international orders. We may refuse to ship to any destination or person where shipping would violate the law.

13. Governing law and disputes

These Terms are governed by the laws of the State of Idaho, without regard to conflict of laws rules. Any dispute will be brought in the state or federal courts located in Kootenai County, Idaho, and you agree to those courts' jurisdiction. Before filing anything, please contact us first. 14. Changes to these Terms

We may update these Terms from time to time. The version posted on this page, with its effective date, applies to your use of the site. An order is governed by the Terms in effect when you placed it.
